5. Do I have to pay or will my case by publicly funded?

In the Police Station

Anyone who is in the police station, whatever their means, provided they are there for an arrestable offence, is entitled to free legal representation.

In the Magistrates Court

If a case is serious a Representation Order will be made. This means that you will not have to pay for a solicitor to defend you. You will usually have to pay the costs of the prosecution if you plead guilty or are convicted.

In the Crown Court

At the conclusion of the case, you may be ordered to pay all or some of your defence costs, depending upon the result of the case and your means. Again depending upon your means you may be ordered to pay towards the prosecution costs.
